The NextSession website and all related features, content, and services (collectively, the "Sites and Services") are owned and operated by NextSession and may only be accessed under the Terms and Conditions described herein.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THE SITES AND SERVICES, YOU AGREE TO BECOME BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU MAY NOT ACCESS OR USE THE SITES AND SERVICES.
We may modify these Terms and Conditions at any time, effective upon posting the updated version to our Sites and Services, with or without additional notice to you. You are responsible for regularly reviewing these Terms. Your continued use of the Sites and Services following any modification constitutes your acceptance of the updated Terms.
Subject to full compliance with these Terms, NextSession grants you a nonexclusive, nontransferable, nonsublicensable, terminable license to access and use the Sites and Services for your personal professional use. You agree not to reproduce, duplicate, copy, sell, re-sell, modify, distribute, transmit, or otherwise exploit the Sites, Services, or any content for any commercial purpose without our express written consent. NextSession may modify, update, suspend, or discontinue the Sites and Services, in whole or in part, at any time and without notice or liability.
Users sign up for accounts through Google authentication. The purpose of your account is to post clinical tips and interventions, comment on content, save tips, and build playlists of professional resources.
Access to the Sites and Services is limited to verified licensed mental health professionals. User access may be denied or revoked if we determine that a User is not a licensed mental health professional. NextSession is currently free to use during early access; we reserve the right to introduce subscription pricing in the future with advance notice to Users.
All users are subject to a manual verification process to confirm their status as a licensed mental health professional. Until verified, access to certain features may be limited. If verification is denied, any account access will be removed. We reserve the right to request supporting documentation and to reject any application at our sole discretion.
The information on our Sites and Services is provided as a professional peer-sharing resource only and is not to be used or relied on for diagnostic or treatment purposes relating to any individual patient. This information is not intended to create a patient-physician or therapist-client relationship, and should not be used as a substitute for professional clinical judgment in any individual case.
NextSession expressly disclaims responsibility, and shall have no liability, for any damages, loss, injury, or liability whatsoever suffered as a result of reliance on the information on this site. NextSession does not endorse any specific test, treatment, therapy modality, health professional, product, or procedure mentioned on the Sites and Services. Never disregard professional judgment or delay seeking clinical supervision because of something you have read on this site.
If a client or patient may be experiencing a medical emergency, call 911 immediately. Reliance on any information provided by NextSession, its employees, Users, or others appearing on the Sites and Services is solely at your own risk.
This disclaimer applies equally to content generated with the assistance of AI tools available on the platform. AI-generated content has not been reviewed by a licensed clinician on behalf of NextSession and should always be evaluated using your own professional judgment before application in a clinical setting.
Certain health and medical information is protected under the Health Insurance Portability and Accountability Act ("HIPAA") and applicable state law. All Users of the Sites and Services agree that by accessing, viewing, or using the Sites and Services in any manner, they agree to comply with all applicable HIPAA regulations and to hold harmless and indemnify NextSession from any intentional or inadvertent disclosure of HIPAA-protected information on the Sites and Services. NextSession does not collect, store, or transmit protected health information (PHI) as defined by HIPAA, and Users are strictly prohibited from posting any patient-identifiable information on the platform.
As a condition of your use of the Sites and Services, you agree not to:
You agree that by using NextSession, you are a licensed or supervised mental health professional. Use of the Sites and Services by non-mental health professionals is strictly prohibited.
We may require that you provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Creating multiple or overlapping accounts may result in termination of all associated accounts.
By submitting any content to the Sites or Services, you grant NextSession a royalty-free, perpetual, irrevocable, worldwide, nonexclusive, transferable, and sublicensable license to use, reproduce, adapt, modify, distribute, and publicly display that content. You represent and warrant that you own or have secured all rights necessary for the content you submit, and that the content does not violate any applicable law or third party rights.
You are solely responsible for your posts. NextSession may, in its sole discretion, remove any content that violates these Terms or that it deems harmful to the community. All posts must reflect your actual first-hand professional experience and knowledge and must be accurate, honest, and truthful.
By posting a tip, you agree that a partial preview of your tip content may be displayed publicly on NextSession to allow search engines to index the platform and help other mental health professionals discover the community. Your personal information, name, and identity will never be displayed publicly. Tip previews are attributed only to "a verified licensed mental health professional on NextSession." The title of your tip may also appear as a preview image when NextSession links are shared on social media platforms. No author name, photo, license information, or any other identifying information is ever included in these social sharing previews.
NextSession offers an optional AI feature ("Ask Elephant") that generates clinical tip drafts based on your input. All AI-generated content posted to the platform is posted under your profile and you are the author of record. You are solely responsible for reviewing, editing, and ensuring the accuracy of any AI-generated content before posting. AI-generated tips are subject to the same conduct standards, accuracy requirements, and clinical judgment obligations as all other user content. NextSession does not warrant the accuracy, completeness, or clinical appropriateness of any AI-generated content. You agree not to post AI-generated content as clinical advice or as a substitute for professional clinical judgment.
NextSession does not guarantee the accuracy, integrity, quality, or appropriateness of any content transmitted through the Service. We act as a passive conduit connecting mental health professionals and are not responsible for content posted by Users. You acknowledge that all content is the sole responsibility of the person from whom it originated, and that you may be exposed to content that is inaccurate, misleading, or offensive. You agree that you must evaluate and make your own independent judgment regarding any content.
NextSession reserves the right to review and delete any content that, in our sole judgment, violates these Terms or is otherwise harmful to the community. By using the Service, you agree that it is solely your responsibility to evaluate the risks associated with any content you access.
You may report content that you believe violates these Terms by emailing us at team@nextsession.com.

Upon termination, you must immediately cease using the Sites and Services. We reserve the right to block, nullify, or deny your access at our sole discretion, and this right is in addition to all other rights and remedies available to us.

If you display, copy, duplicate, reproduce, sell, or exploit any content in violation of these Terms, you agree to pay One Hundred Dollars ($100) for each record or report so exploited.
These Terms and Conditions, together with our Privacy Policy and any other policies incorporated herein by reference, constitute the entire agreement between you and NextSession with respect to the Sites and Services, and supersede all prior or contemporaneous negotiations, discussions, or agreements.
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising under these Terms. Any claim or cause of action must be filed within one (1) year after it arose or it will be permanently barred. All disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules, with arbitration to be held in Los Angeles, California before one arbitrator.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining Terms shall remain in full force and effect. These Terms are not assignable, transferable, or sublicensable by you without NextSession's prior written consent. No joint venture, partnership, employment, or agency relationship exists between you and NextSession as a result of these Terms.
